Rule 17
Able to assign cases

(1) Under sub-section (3) of Article 137 of the Constitution, if a case under consideration in the Supreme Court involves a question of serious constitutional interpretation, the Chief Justice may designate such a case to be heard by a constitutional bench.
(2) In determining the case according to sub-rule (1), in addition to other matters, the following matters may also be generally considered:-
(a) If a case under consideration in another bench involves a question of constitutional interpretation and the judgment of the same is appropriate to be given by the constitutional bench, if the concerned bench orders it to be submitted to the Chief Justice,
(b) If a case pending before the Supreme Court involves a question of serious constitutional interpretation and the party to the case submits an application to the Chief Justice that it should be decided by the Constitutional Bench,
(c) Before the constitution of the constitutional bench, two different benches of the same level of the Supreme Court have given different interpretations on the same constitutional question and uniformity has not been maintained and if the Chief Justice deems it necessary to make a decision on the matter by the constitutional bench.
