(1) If during the investigation according to section 10 it is found that a case should be filed, within the scope of filing such case, the commission shall recommend to the relevant body to file a case and inform the relevant person as well. But in the case of a case which is rejected by the Government of Nepal, it will have to be submitted to the Attorney General.
(2) When making a recommendation in accordance with sub-section (1), the commission may also provide copies of the facts, documents and evidence collected during the investigation that will assist in filing the case to the relevant body.
(3) If there is a written request to prosecute the case according to sub-section (1), the Attorney General shall investigate the matter and decide whether or not to prosecute the case.
