Section 203

The Supreme Court, in accordance with the clause (1) of Article 134 of the Constitution of Nepal, may refer the case pending in any High Court to the Supreme Court for trial, hearing and settlement.
(2) The Supreme Court may, in accordance with Article 134 of the Constitution of Nepal, order the case pending in one High Court to be processed, heard and set aside in another High Court.
(3) The High Court may, in accordance with clause (2) of Article 145 of the Constitution of Nepal, order that a case pending in one of its subordinate district courts be heard in another subordinate district court.
(4) Whether or not there is a condition to transfer the case under sub-section (2) or (3) shall be decided on the basis of the application of the relevant party of the case or the information obtained through any other means. If there is a reason, the concerned court shall send a report to the court hearing the appeal mentioning such matter, and if the report is received accordingly, the court hearing the appeal may order to transfer such case to another court of the same level of its territorial jurisdiction, considering the convenience of the parties.
(5) If there is an order under sub-section (2) or (3) and (4A), such court shall proceed, hear or dispose of such case in accordance with the order of the Supreme Court or the High Court.
(6) According to sub-section (2) or (3) and (4A), even if the case is settled by another court, the decision of such court shall be appealed to the court hearing the appeal of the court where the petition was originally filed.
