to rule 38 of the original regulation

Instead of sub-rule (2) of rule 38 of the original regulation, the following sub-rule (2) has been placed:-

“(2) To adopt the following procedures while transferring civil servants It shall be required:-

(a) When transferring a civil servant from one place to another, the office and geographical area where the employee is working, the period of service for which the transfer is proposed, the office and geographical area, the period of transfer and the reason for the transfer should be disclosed in the transfer decision.

(b) After the decision to transfer the civil servant, the employee who will be transferred within three days of such decision Schedule – 11A. The following transfer deed should be issued. After receiving such a letter of transfer, the concerned office shall issue a letter of reprimand as per Schedule-12 within the period as per Rule 40.

(c) Any civil servant who has been transferred without giving reprimand within the period as per Clause (b) from the office to which he has been transferred. In case of payment of salary allowance, the salary allowance received by such civil servants for a period exceeding the period to be given a refund shall be collected from the head of the office and the head of the account that provided the salary allowance without giving such a refund.

The authority who transfers this will be punished departmentally.”
