(1) If a seasonal establishment is closed during the off-season, the workers working in such an establishment shall be kept on standby for the duration of the establishment's closure. Explanation: For the purpose of this section, "seasonal establishment" means an establishment that can be operated only during a particular season and the term also refers to an establishment that cannot be operated for more than one hundred and eighty days in a year.
(2) Notwithstanding anything else written in this Act, the employer shall pay to the workers in regular employment an amount equal to twenty-five percent of the wages he would have received during the off-season period when the seasonal establishment is closed.
(3) If a question arises whether an establishment is a seasonal establishment or not, the office will decide the same.
