Section 67
<br> not to follow the procurement process according to this Act
Notwithstanding anything written elsewhere in this Act, the procurement procedure as per this Act shall not be followed in the following cases:-
(a) If the Government of Nepal decides that it is not appropriate from the point of view of national security or defense to make security, strategic or defense related purchases by following the procedure under this Act, or
(b) According to the agreement between the government of Nepal and the donor party, if the purchase is made in accordance with the procurement guidelines of that party,
(c) If any goods or services are to be purchased for business operation by the public body as specified to conduct commercial transactions in competition with the private sector,
(d) In case of purchase abroad as specified for activities such as fairs, festivals, trade fairs or exhibitions organized abroad for social, cultural programs or industrial, economic, technology demonstration and promotion,
(e) If public bodies such as Nepali embassies and missions located abroad have to purchase goods or services,
(f) If the public body approved to operate aircraft services has to purchase equipment related to aviation or aircraft.
(2) When making a decision according to clause (a) of sub-section (1), the government of Nepal shall determine the reason for the purchase and also determine a separate procedure for that. (3) The public body shall make necessary procedures for the procurement as per clauses (c), (d), (e) and (f) of sub-section (1) after obtaining the consent of the Public Procurement Monitoring Office and shall be approved and implemented.
(4) The procedures made by the public body according to sub-section (3) shall include the business plan, life cycle and net present value for procurement as per clause (f) of sub-section (1).
