(1) Notwithstanding anything written elsewhere in this Act, no provision of this Act shall apply to any communication establishment designated by the Government of Nepal in consultation with the Committee by publishing a notice in the Nepal Gazette.
(2) Pursuant to sub-section (1), the Government of Nepal may take the following grounds when determining that any provision of this Act shall not apply to any communication establishment:-
(a) Sales number of newspapers,
(b) Capacity of radio equipment,
(c) Number of cable television subscribers,
(d) Number of online magazines with hits,
(e) Program Product Number,
(f) Number of news distribution.
