Rule 53
Passenger Insurance
: (1) When the owner or manager of a vehicle operating a transport service provides passenger accident insurance in accordance with section 150 of the Act, in the case of a passenger vehicle, the number of seats equal to the number of seats in the vehicle and in the case of a cargo vehicle, the number of seats as mentioned in the blue book of the vehicle. An equal number of passengers should be insured for death, dismemberment and medical expenses.
(2) In the case of insurance as per sub-rule (1), one hundred thousand rupees for each passenger above five years of age, fifty thousand rupees for each passenger between one year and five years of age and twenty five thousand rupees for each passenger under one year of age shall be insured for death caused by a vehicle accident.
(3) In the event of an accident involving a vehicle involved in the transport service and the death of a passenger, the owner or manager of such vehicle shall immediately provide twenty-five thousand rupees to the rightful person as per the inheritance of each deceased, and such owner or manager shall provide insurance as per sub-rule (2). He can take inquiry from the amount.
(4) When insuring according to sub-rule (1), the following insurance shall be provided for dismemberment:
(5) Insurance as per sub-rule (1) shall be insured as follows for the treatment expenses of injuries, sick expenses and miscellaneous expenses:-
(a) Actual medical expenses up to one lakh rupees,
(b) Medical expenses and miscellaneous expenses for a maximum of thirty days at the rate of five hundred rupees per day for the period of hospitalization.
(6) Notwithstanding anything else written in this rule, in the event of an accident involving a vehicle carrying more passengers than the number of seats in the vehicle, resulting in the death or dismemberment of a passenger traveling without a seat, or if such passenger is injured, the owner or manager of such vehicle shall pay the insurance amount specified in this rule. An equivalent amount should be given as compensation to the deceased's heirs or the disabled person or the injured.
(2) In the case of insurance as per sub-rule (1), one hundred thousand rupees for each passenger above five years of age, fifty thousand rupees for each passenger between one year and five years of age and twenty five thousand rupees for each passenger under one year of age shall be insured for death caused by a vehicle accident.
(3) In the event of an accident involving a vehicle involved in the transport service and the death of a passenger, the owner or manager of such vehicle shall immediately provide twenty-five thousand rupees to the rightful person as per the inheritance of each deceased, and such owner or manager shall provide insurance as per sub-rule (2). He can take inquiry from the amount.
(4) When insuring according to sub-rule (1), the following insurance shall be provided for dismemberment:
