(1) Regarding the following matters, it will be as follows:
(a) This Act shall not apply in relation to Nepali Army, Nepal Police, Armed Police Force and National Investigation.
(b) In the case of civil service, the provisions of the prevailing civil service law shall apply.
(2) In the case of services and special economic zones established by a special law, if the conditions and facilities of the service are mentioned in the prevailing Nepal law, such service shall be as per the same.
(3) If there is no provision in the prevailing Nepalese law regarding the remuneration, service conditions and facilities of a worker, the provisions of this Act shall automatically apply to the remuneration, service conditions and facilities of such worker.
(4) When deciding, ordering or deciding that this Act is not applicable to any worker, the rights and facilities provided by this Act shall also be disclosed according to which law has been provided to such worker.
(5) If the employer of the establishment to which the Labor and Journalists Act, 2051 applies, enters into an employment contract in accordance with this Act, or if the provisions of this Act are applicable between the workers of such establishment and the employer, the provisions of this Act shall also apply to such workers.
