Section 13
Protection of composer, presenter, sound producer or broadcasting organization
(1) The works of the following authors shall be protected under this Act:-
(a) a work published in the State of Nepal or the same country composed by an author residing in the State of Nepal or a member country of the World Trade Organization,
(b) Audio-visual works produced by producers residing in the State of Nepal or a member country of the World Trade Organization,
(c) Architectural design of a building made within the State of Nepal or a member country of the World Trade Organization or any other type of artistic composition used in a building or any other structure, (d) A work published in the State of Nepal by an author residing in a country other than the State of Nepal or a member country of the World Trade Organization. or an audio-visual composition produced in the state of Nepal by a producer of such a country.
(2) The following presenters shall have the rights related to presenters under this Act:-
(a) State of Nepal or a representative of a member country of the World Trade Organization,
(b) Any presentation presented in the State of Nepal or a member country of the World Trade Organization or a presentation used in a sound recording protected under this Act or a presentation included in the broadcast even if it is not included in the sound recording.
(3) The following producers of sound recordings shall have the rights related to producers of sound recordings in accordance with this Act:-
(a) Sound recording produced by a person from the State of Nepal or a member country of the World Trade Organization,
(b) sound recording published in the State of Nepal or a member country of the World Trade Organization,
(4) The following broadcasting organizations shall receive rights related to broadcasting organizations in accordance with this Act:-
(a) Broadcasting broadcast by a broadcasting organization having an office in the State of Nepal or a member country of the World Trade Organization,
(b) Broadcasting broadcast from a broadcasting center located in the State of Nepal or a member country of the World Trade Organization.
