(1) If any item withheld as per Rule 9 is not used immediately, it is rotten or if the period of use has expired, the board or the market protection officer shall sell such item by public auction.

However, if it is found that such an item has an adverse effect on the health of the consumer due to quality or any other reason, the item shall be destroyed in such a way as not to affect the environment.
(2) According to sub-rule (1), the amount received from the auctioned items shall be deposited by the board or the market protection officer in the bond account of their office as determined by the court.
(3) Notwithstanding anything written in sub-rule (1), the board or the market protection officer shall not be responsible for such item if it is destroyed in accordance with the sub-rule, if the item withheld as per rule 9 rots or cannot be sold at auction due to circumstances beyond the scope of this rule.
