Stopping or demolishing

10.1 Under section 9, if someone does the things regulated, controlled or prohibited by the committee without the prior approval of the committee or if the committee has set any conditions or criteria while giving approval, if the committee does such things in a way that is contrary to such conditions or criteria The committee may give an order to stop the work immediately and if any construction has been done in the course of such work, the committee may give a deadline of thirty-five days and order the concerned person to demolish or remove the parts that have been constructed without the approval of the committee or against the conditions or standards. 10.2 According to sub-section 10.1, a person who is not satisfied with the order given by the committee to demolish or remove a part of a structure may file a complaint before the appeal committee under section 20 within thirty-five days from the date of receiving the order. Regarding the complaint, the appeal committee has to make a decision within thirty days from the date of filing of the complaint and such decision will be final. 10.3 If a complaint is received as per sub-section 10.2, if the appeal committee decides to demolish or remove part of such construction, within thirty-five days from the date of such decision, and if no complaint is received, within thirty-five days from the date of the committee's order as per sub-section 10.1, the concerned person shall demolish or remove part of such construction. . 10.4 If the concerned person does not demolish or remove the part of such construction within the time limit of sub-section 10.3, the committee may demolish or remove it by itself and the expenses incurred in such demolition or removal shall be recovered from the concerned person as government dues. 10.5 According to sub-section 10.4, when the committee itself demolishes or removes part of any construction, it shall be demolished or removed at the discretion of the member of the respective ward of the rural municipality or municipality. When demolishing or removing in this way, the committee will not be held responsible if more parts are destroyed than the part that should be demolished or removed, and the concerned person will not be entitled to claim compensation for the damage caused. 10.6 In accordance with sub-section 10.1, if the committee has ordered the demolition or removal of a part of a structure, such property shall not be demolished or removed until such part of the structure is demolished or removed.The committee shall send a written notice to the concerned body to prevent any person from giving away the right or mortgage, and the concerned body shall also do so in writing.
