Rule 3
Procedure for obtaining certificate of Nepali citizenship as a descendant

(1) A Nepali citizen who has completed sixteen years of age who wishes to obtain a certificate of Nepali citizenship as a descendant should submit an application in the format as per schedule-1 to the concerned Chief District Officer with the following documents attached -
(a) Certificate of Nepali citizenship of father or mother or relatives within three generations of their descent,
(b) Recommendation or birth registration certificate issued by the concerned local body to reveal the place of birth and relationship,
(c) In case of submission of the certificate of citizenship of a relative within three generations according to clause (a), a letter confirming the relationship with the said relative,
(2) A Nepali citizen who cannot submit the evidence as per sub-rule (1) with the application can be given a certificate of Nepali citizenship on the basis of the following documents -
(a) On-the-ground survey conducted by local residents who have obtained a certificate of Nepali citizenship in the format as per Schedule-3 to the representative of the local body in order to reveal the fact that the petitioner's father or mother is a Nepali citizen and that he is a citizen of Nepal by virtue of his descendants and has been born in Nepal and has continuously resided in Nepal.
(b) Three Nepali citizens living in the respective ward who have obtained a certificate of Nepali citizenship have given their identification in the format as per schedule-4 at the place of the survey. But if the person who identifies himself to the officer recommending citizenship or granting citizenship is suspicious, such an officer can investigate it further.
(3) A person who has reached the age of 18 years and does not have the address of his father or mother found in Nepal, and who wishes to obtain a certificate of Nepali citizenship, should attach the following documents and submit an application to the concerned Chief District Officer in the format as per Schedule-1. (a) If he grew up under the protection of a kindergarten approved by the Government of Nepal or an organization for the protection of orphaned children or an orphanage, such an organizationRecommendation,
(b) Copy of the citizenship certificate of the fostering person, if a particular person has obtained guardianship and fostering in accordance with the prevailing law,
(c) Identification issued by the head of the fostering organization in the organization as per clause (a) or identification issued by the person providing fostering as per clause (b),
(3a) According to sub-section (4) of Section 3 of the Act, a person who has completed sixteen years of age and wishes to obtain citizenship of Nepal on the basis of descent, should submit an application to the concerned Chief District Officer in the format as per Schedule-1 with the following documents attached:-
(a) Certificate of Birth,
(b) Certificate of Nepalese citizenship of both father and mother,
(c) The recommendation made by the concerned local level to reveal the place of birth and relationship.
(3b) According to sub-section (5) of Section 3 of the Act, born in Nepal from a mother who is a citizen of Nepal and has lived in Nepal and the father has not been identified, he has completed sixteen years of age. If a person wants to get Nepalese citizenship on the basis of descent, he should submit an application to the concerned Chief District Officer in the format as per Schedule-1, attaching the following documents:-
(a) Certificate of Birth,
(b) Mother's certificate of Nepalese citizenship,
(c) The recommendation made by the concerned local level to reveal the place of birth and relationship,
(d) The recommendation made by the concerned local level to reveal the fact that he was born in Nepal and is living in Nepal and his father has not been identified. (e) "A person who cannot identify the father" Schedule-4A. In the following format and his mother in Schedule-4B. Self-declaration made before the chief district officer or the officer designated by him in the following format, but if the mother of such person has died at the time of application, the death registration certificate and the recommendation made by the approved doctor if the person is not in the hospital, Schedule-4A. The following self-declaration should be attached. (4) If there is any additional matter to be understood regarding the application received under sub-rule (3), (3A) or (3B), the recommendation of the local body or the police as required.A report can be requested.
(5) Upon investigation of the application received in accordance with sub-rule (1), (3), (3A) or (3B), if the applicant is found eligible to receive a certificate of citizenship as a descendant, a certificate of citizenship may be issued to him as a descendant.
(6) In the place where the father or mother's name should be mentioned in the citizenship certificate of a person without paternity and maternal address, the name, surname and address of the guardian should be mentioned.
(6a) In accordance with the application filed under sub-rule (3b), the identity of the father, the certificate of citizenship to a person who does not have the identity of the father - when issuing the certificate of father, the name, surname and address of the father should be mentioned in the certificate of Nepali citizenship. (7) Citizenship certificate can be issued on the basis of the registration record prepared by the citizenship team appointed from time to time and the temporary certificate distributed before the commencement of this rule.
(8) According to sub-rule (2), the list of persons who have applied to obtain a certificate of Nepali citizenship shall be made public on the same day.
