Rule 5
Provisions related to tariff facilitation of goods from abroad via Nepal to another part of the same country
(1) Consignors who want to take any goods from a foreign country to another part of the same country through Nepal must submit an application to the department along with the reason for using the Nepal route, the name of the customs office that will import into Nepal and export from Nepal, and the details of the goods.
(2) If, upon examination of the application received in accordance with sub-rule (1), the department finds that the practice is serious, the department will grant permission to take such goods from abroad to another part of the country via Nepal. Before granting such permission, the department may request a letter of recommendation from the embassy or diplomatic mission of the concerned country in Nepal.
(3) After receiving the permit according to sub-rule (2), the cargo owner shall attach such permit and submit the declaration form along with the cargo to the relevant customs office. In such notification, the customs office from which the goods are to be re-exported should be clearly disclosed.
(4) If notification letter is received according to sub-rule (3), the relevant customs office shall open the details of such goods and affix the seal of its office, and set a maximum period of seven days for the said goods to be brought to the specified place from any part of the foreign country via Nepal to another part of the same country. A copy of the declaration form should be given to the owner of the goods and allowed to take the goods according to the permission of the department.
(5) If the declaration given in accordance with sub-rule (4) and the documents related to the goods and transportation are submitted to the customs office of export, and if all the details are found to be correct, the said customs office will allow the export of such goods without charging customs duty, stating the same in the declaration letter and the declaration letter. Attach a copy and send the information to the importing customs office within three days.
(6) After receiving the information in accordance with sub-rule (5), the customs office authorized to import shall issue a certificate from the consignee.If he has taken a bond, he will have to return the bond. However, if the previously imported goods are found to have been partially exported, if the goods are not exported, the customs duties on the goods must be deducted from the bond and collected from the bond, and if the goods are not deposited, the customs duties on the goods must be collected from the concerned person.
(7) Notwithstanding anything else written in this rule, if there is any bilateral treaty or agreement between the government of Nepal and the government of the respective country, the provisions of such treaty or agreement shall be fulfilled when goods prohibited for importation into Nepal are transported from abroad to another part of the same country using the road of Nepal. .
