(1) If any Nepali citizen wants to open a school under the educational guthi, the prescribed details should be submitted to the relevant village education committee or town education committee for basic schools and district education committee for secondary schools along with the recommendation of the concerned district education committee. An application for permission must be submitted.
(2) If an application is received according to sub-section (1), the Government of Nepal or the designated authority will carry out the necessary investigation on the application and if it is deemed necessary to allow the school to be opened during the investigation, the permission will be granted subject to the prescribed conditions and restrictions.
(3) If it is found that the school opened with permission according to sub-section (2) complies with the prescribed conditions, the Government of Nepal or the designated authority will grant approval.
(4) When this section commences, If the school that is operating as a company sometimes wishes, it can submit an application to the designated authority to dissolve the company and operate the school under the educational guthi. If the request of the applying school is reasonable, the school will be approved to operate according to the request. Permission or approval shall not be given to:-
(a) a school operating in a government or public building,
(b) a school operating in a government or public land,
(c) A school built and operated in that building or on such land for a person or organization to donate a building or land in the name of a school.
(7) Subsections (2), (3) and (5) ) regardless of what is written in the respective village development committee or municipality will give permission or approval to open a pre-primary school from its own resources.

(7c) Regardless of what is written in this Act or other prevailing laws, while running a school under the educational guthi, the following shall be done as follows:-
(a) The trustees of the educational cooperative should be organized as an organization, (b) At least if the board of directors (trustees) is public while conducting the educational cooperative. There should be five members and at least three members in the case of a private group. The trustee (trustee) of the existing Guthi can appoint his successor who will work as Guthiyar during his lifetime or after the remainder.
However, in the case of public educational Guthi, the approval of the Ministry must be obtained when appointing such a successor.
(7D) ) If a social, charitable or welfare organization wants to operate a school with the purpose of not making profit, it can operate the school under the public educational guthi after taking approval from the designated authority. , the conditions to be followed and other provisions shall be as prescribed.
(8) Notwithstanding anything written in sub-section (1), (2) and (3), no one shall establish a school in association with any foreign educational institution. Permission or approval will not be given to open.
However, if there is an agreement with the Government of Nepal regarding the opening of a school in association with a foreign educational institution, or if there is a recommendation from a diplomatic mission to open a school, the Government of Nepal may grant permission or approval to open a school under certain conditions. An application can be made directly to the Government of Nepal to open such a school.
(9) If a school that has received permission or approval according to sub-section (8) does not operate the school in accordance with the conditions, the Government of Nepal may close such school at any time.
>(10) Any other provisions under this Act shall not be applicable in relation to the school which has received permission or approval in accordance with sub-section (8).
