Section 163
<br> as the department or office may decide
The department may carry out necessary investigations in relation to the following complaints:
(a) To issue necessary orders subject to this Act by imposing a fine of up to two lakh rupees on the person who supplies labor without taking a license in accordance with this Act and employs the person through such supplier,
(b) In accordance with this Act, a person who employs a foreigner without obtaining a labor license shall be fined up to two lakh rupees based on the number of workers and if such foreigner is employed after such punishment, an additional fine of five thousand rupees per person per month shall be imposed,
(c) To order to maintain equality by imposing a fine of up to one lakh rupees on the person who discriminates against paragraph-2 while hiring or after hiring,
(d) To order a person who hires a person without giving an appointment letter or without an employment contract to issue an appointment letter or an employment contract with a fee of ten thousand rupees up to five lakh rupees,
(e) According to paragraph-15, if the inspector does any act negligently or maliciously and causes harm, to take departmental action against such inspector according to the prevailing law,
(f) To issue necessary orders if someone practices unfair labor, transfers against the provisions of this Act in such a way as to cause injustice to the workers, or takes action related to promotion contrary to the regulations of the establishment,
(g) If a time period is mentioned in relation to the work to be done by the office in accordance with this Act and the rules made under this Act, if the work is not carried out by the office within thirty days after the end of that period, to give necessary instructions to the relevant office, If there is a dispute between the labor supplier and the main employer, to take necessary actions to resolve the dispute.
(2) The office may carry out the necessary investigation in relation to the application under the above subject and do as follows:-
(a) employment at less than the minimum wage or remuneration or benefits contrary to the Act or rules made under this Act;(b) Employers, workers or other persons who obstruct government employees in the course of their duties, submit fraudulent statements, make false statements, exert undue influence or attempt to do so, twenty thousand To fine up to Rs.,
(c) To impose a fine of ten thousand rupees per trainee or trainee on the employer who employs any person as a trainee or trainee in contravention of this Act, and order to keep the person working as a trainee or trainee on a regular basis and to give an order to give the wages and benefits accordingly,
(d) To order the employer to pay such compensation and double damages to the employer who does not deposit the gratuity received by the workers or the amount for the provident fund or the amount to be deposited in the social security fund or does not pay the medical treatment expenses or does not provide insurance for the compensation in accordance with the rules made under this Act. To give instructions to the employers who retain employees in a discriminatory manner not to act in such a way, (f) To give necessary instructions to the employers who terminate the employment or do not allow them to attend work contrary to the rules or regulations made under this Act.
(3) Notwithstanding anything written elsewhere in this section, it shall not be considered that any laborer is hindered from making an application to the employer by adopting the process of individual dispute resolution and resolving the dispute accordingly.
(4) Complaints filed in the department or office will be dealt with and decided as prescribed
