(1) The Government of Nepal shall establish a Criminal Assets Management Department to manage and auction assets obtained from crimes and related instruments.
(2) The Government of Nepal shall appoint at least a gazetted first class officer of the civil service as the Director General to act as the head of the department.
(3) The organizational form of the department and the staff positions required by the department will be as prescribed by the Government of Nepal.
(4) Notwithstanding anything written elsewhere in this section, until the department is established, the Government of Nepal may appoint any other department or directorate to carry out the work performed by the department in accordance with this Act.
