(1) The Commission may itself take departmental action or send a letter to the authority to take departmental action against the employee or security personnel who are required to take departmental action according to this Act, and in the case of officials who are not subject to departmental action, the commission will send it in writing to the relevant agency to take action according to the prevailing law.
(2) The Commission shall immediately prohibit the person who has been prosecuted or recommended for prosecution in accordance with sub-section (1) from carrying out election-related work.
(3) If there is a recommendation for action according to sub-section (1), the authority shall take action against such person within three months and inform the Commission thereof.
(4) The Commission shall send a written action to the Government of Nepal to take departmental action against the authority who has not informed the Commission after taking action as per sub-section (3) and the action sent in writing shall be made public for the information of all.
