Dispute Resolution Procedure
(1) According to section 43, if there is a dispute related to the name, seal, flag or symbol of the party, the party claiming such name, seal, constitution, flag or symbol, and if there is a dispute regarding the authority of the official, central committee or the decision of the central committee, such official, central committee or The party claiming the authority of the decision of the Central Committee must submit the claim with the basis and evidence to the Commission within thirty days of the initiation of the dispute with the signature of forty percent of the members of the Central Committee of the party.
(2) The Commission shall attach a copy of such claim and evidence to submit a written reply to the claim under sub-section (1) and give a notice of fifteen days to the other party.
(3) Upon receipt of the notice as per sub-section (2), within such period, the concerned party shall submit his written reply and the basis and evidence to confirm it. However, if the written answer cannot be submitted within such period, the commission may extend the deadline by ten days to submit the written answer at the request of the concerned party.
(4) After submission of the written answer within the period as per sub-section (3) and if the written answer is not submitted, after the expiry of the period to submit the written answer, the Commission shall give notice to the relevant parties of the dispute to appear before the Commission for the purpose of resolving the dispute as per mutual agreement.
(5) If the parties to the dispute attend and agree to settle the dispute within the period as per sub-section (4), the Commission shall settle the dispute according to the agreement reached between the parties.
(6) If the agreement cannot be reached according to sub-section (5), the Commission may recognize one of the parties based on the claim, written answer and evidence as per sub-section (1) and (3), and if it is not recognized according to the same and in that manner, sub-section (1) Among the officials and members of the Central Committee submitted to the Commission on behalf of such party before submitting the claim to the Commission, the party with the majority of the officials and members of such committee shall be recognized as the party before the dispute arose and the other party shall be recognized as a separate political party.can register.
(7) If a party does not have a majority in making a decision in accordance with sub-section (6), the commission shall make a decision according to the evidence submitted by the parties to the dispute, the relevant party's statutes and other related matters.
