(1) The department may declare an area as a prohibited area for mineral work from the point of view of national security, public interest or historical importance, or allow mineral work to be carried out under special conditions in relation to an area.
(2) In the area where the permission to do mineral work has been given by the department, the mining work of the licensed person may be done by himself or by giving permission to any other person, except for the mineral material that has been given permission for the mineral work.
(3) The Government of Nepal may specify that only the department or other government agencies designated by the department can carry out the mineral work of a particular mineral.
(4) The Government of Nepal may make separate arrangements as specified in relation to mineral materials such as clay, stone and sand used in construction work so as not to adversely affect the practice of using them for private use by the general public.
