5. Refuse to register a pesticide (1) If the applicant applying for registration of a pesticide cannot prove the need for the use of such pesticide in Nepal or if the office sees the possibility that the use of such pesticide will have an adverse effect on humans or animals or the environment, the reason for the same As mentioned, the office may refuse to register such a pesticide.

(2) According to sub-rule (1), if the office refuses to register any pesticide, it shall give the applicant a notice including the reason.

(3) The petitioner who receives the notice as per sub-rule (2) may apply in writing to the committee to review such decision and the decision made by the committee regarding such application shall be final.
