Section 8
<br> to be informed of the commencement of commercial production or business
An industry registered in accordance with this Act shall start operating the industry or its commercial production or business within the period mentioned in the industry registration certificate and shall inform the industry registration body.
(2) If an industry is not able to operate the industry or start its commercial production or business as per sub-section (1), for that reason, it may apply to the industry registration body to extend such period at least one month before the end of the period mentioned in the open industry registration certificate, as prescribed. "(2A) Any industry that fails to submit an application within the period specified in sub-section (2) may submit an application to the industry registration body to extend the period mentioned in such certificate within six months from the date of expiry of the period mentioned in the open industry registration certificate. But in the case of other industries that are registered before November 7, 2073, except those that require a permit, and have not been able to start operations or production or business even within the previously extended period, such an application should be made within three months from the date of commencement of this sub-section."
(3) If an application is received "according to subsection (2) or (2A)" instead of sub-section and if the reason mentioned in the application is reasonable, the industry registration body may extend the period for starting the operation or commercial production or business of such industry as specified. - But in the case of the application given under sub-section (2A), considering the progress of the work to be done for the establishment of the industry including construction, the industry shall be operated by charging a fine of twenty five thousand per year in the case of small industries, seventy five thousand per year in the case of medium industries, and one hundred and fifty thousand per year in the case of large industries or The period for starting commercial production or business can be extended.”
(4) If the period is extended according to sub-section (3), the related industry shall start the operation of the industry or its commercial production or business within that period.
(5) Sub-section “subIf an application is not given to extend the period according to clause (2) or (2a) or if such industry does not start operating the industry or its commercial production or business even within the period according to sub-section (1) or the extended period according to sub-section (3), the registration certificate of such industry will be canceled automatically.
(6) If the registration certificate of the industry is canceled according to sub-section (5), the registration certificate of such industry in the records of the industry registration body shall state the reason for cancellation and the record shall be updated.
(2) If an industry is not able to operate the industry or start its commercial production or business as per sub-section (1), for that reason, it may apply to the industry registration body to extend such period at least one month before the end of the period mentioned in the open industry registration certificate, as prescribed.
