Section 11
Fund's Rights
in case of breach of condition (1) According to the agreement made in accordance with section 10, if any borrower violates the conditions mentioned in the agreement with the fund without paying the loan, the interest and the remaining amount due to the fund, or if there are sufficient grounds that such loan amount cannot be paid with the borrower, even if the loan period has not reached, the fund will take the loan from the borrower. In order to demand the refund of the amount owed or to give a loan, the property held as a mortgage or other properties of such debtor can be seized and used in accordance with the prevailing law, restored or leased, or sold by auction, bid or mutual discussion to recover the amount due.< br> (2) According to sub-section (1), if the fund seizes the debtor's property and sells it through auction, bidding or mutual discussion, the fund shall take the amount to be received and return the excess amount to the related debtor.
(3) According to sub-section (1), if the debtor's property cannot be sold at auction despite repeated attempts through auction promotion, bidding or mutual discussion, or if selling at the received price does not appear to be in the interest of the fund, the fund may take ownership of the property itself by fixing the value of the debtor's property as specified.
