Section 16
Punishment –
(1) If someone employs someone as a wage laborer contrary to section 4, the officer hearing the case shall fine such person from fifteen thousand rupees to twenty five thousand rupees and pay double the minimum wage rate determined in accordance with this Act for each day that such person is employed. br> (2) If a person does not return the property pledged or secured as per Section 7, the officer handling the case shall fine such person from ten thousand rupees to fifteen thousand rupees and return the property to the concerned person.
(3) If a person employs someone without paying wages as per Section 13 or by paying less than the minimum wage, the officer who hears the case shall fine such person from one thousand rupees to three thousand rupees and for each day of such employment, double the minimum wage rate determined in accordance with this Act shall be charged to the person employing such work. (4) If any person obstructs anyone in the course of investigation of an action in violation of this Act, the investigating officer shall fine such person from three thousand rupees to ten thousand rupees.
(5) If any person commits any other act contrary to this Act and the rules made under this Act, except as mentioned in sub-sections (1), (2), (3) and (4), the officer hearing the case shall fine such person from one thousand rupees to three thousand rupees.
(6) If a person makes a false complaint knowingly or with the intention of hurting someone, the officer handling the case shall fine such person from one thousand rupees to three thousand rupees.
(7) If the person who works as per sub-sections (1), (2), (3), (4), (5) and (6) is in a position of public benefit or the person who has been punished for working contrary to this Act, the same work again. If it is done, the officer who hears the case will punish such a person twice the punishment written in that sub-section.
