(1) A person who commits the following offense shall be punished as follows:-
(a) A person who commits an offense under Clause (a) of Section 39 shall be liable to a fine of Rs. (b) A person who commits an offense under Clause (b) of Section 39 shall be liable to a fine of Rs. (c) A person who commits an offense under Clause (c), (d) or (e) of Section 39 shall be liable to a fine of Rs. (d) A person who commits an offense under Clause (f) of Section 39 shall be liable to a fine of Rs. (e) A person who commits an offense under Clause (g) of Section 39 shall be sentenced to half of the punishment imposed on the principal offender.
(2) If someone commits an offense under section 39 using a licensed organization, the person who commits such an offense, the director, officer or employee of the licensed organization shall be punished in accordance with sub-section (1).
(3) If the identity of the director, officer or employee of the organization that received the license cannot be identified in accordance with sub-section (2), the director, officer or employee working as the head of the organization that received the license at the time of such offense shall be punished in accordance with sub-section (1).
