(1) Until the construction, extension or improvement of any public road is completed, the Roads Department may temporarily acquire any land for the following works –
(a) To keep construction materials and equipment necessary for the construction, expansion or improvement of such road or to make houses, huts for the residence of persons who supervise or control the work related to such construction, expansion or improvement,
(b) To make a temporary separate road that is necessary to carry the related goods or equipment until the completion of the construction, expansion or improvement of such road.
(2) The following immovable property shall not be acquired except in special circumstances for the purpose mentioned in sub-section (1) –
(a) A house, tower or building used by a person for his residence, (b) Land being used for a place of worship, school, hospital, dharmashala or orphanage. (3) Land acquired in accordance with sub-section (1) If it is done, after the completion of the work, such land shall be returned to the respective land owner or his rightful owner in case of complete acquisition.
