Rule 7
Services, conditions and facilities of Member-Secretary
(1) The member-secretary of the council will be the chief administrative officer working full time.
(2) The tenure of the member-secretary shall be four years (2A) Notwithstanding anything written in sub-rule (2), if the member-secretary lacks efficiency, if he does not fulfill his official responsibilities or if it is proved that he has done any act contrary to the interest of the council, the Government of Nepal may remove him from the position of member-secretary at any time on the recommendation of the council. But before removing him from the position, he will not be deprived of a reasonable opportunity to submit an explanation.
(3) Member-Secretary will get leave and other facilities similar to the employees of the Council. The member-secretary has to take the approval of the chairman while on leave.
(3A) If the employee assigned to the position of Member-Secretary does not remain in the position of Member-Secretary for any reason, his position in the Council will automatically terminate.
(3B) If the member-secretary does not remain in that position for any reason, he/she will get the compensation according to that position, unless otherwise provided in accordance with the prevailing law.
(3c) Unless a member-secretary is appointed in accordance with the Act or regulations, or in the absence of a member-secretary, the most senior employee of the council shall act as acting member-secretary. However, if he has to stay on holiday and home leave of up to seven days, he can stay by verbally informing the chairman.
(4) The remuneration and other benefits of the member-secretary shall be as prescribed by the Government of Nepal.
