Section 17
Regarding member-secretary
: (1) There will be one member-secretary in the council to act as the executive head of the council.
(2) To be appointed to the post of Member-Secretary, one should have the following qualifications:-
(a) Nepali citizens,
(b) At least graduation from a university recognized by the Government of Nepal,
(c) Working in the field of sports for at least five years,
(d) not disqualified by applicable law,
(e) completed thirty years of age.
(3) The Ministry shall form a three-member recommendation committee consisting of two experts including one woman from the relevant field designated by the Ministry under the coordination of the Secretary of the Ministry to recommend for appointment to the position of Member-Secretary from among the persons who have fulfilled the qualifications as per sub-section (2).
(4) The recommendation committee as per sub-section (3) shall recommend to the ministry the names of three suitable persons, including one woman, for the appointment of member-secretary from among the persons who meet the qualifications as per sub-section (2).
(5) The procedure to be followed when making a recommendation in accordance with sub-section (4) and other procedures related to its meeting shall be as determined by the recommendation committee itself.
(6) The Ministry will submit to the Government of Nepal, the Council of Ministers for the appointment of member-secretaries from among the persons recommended under sub-section (4).
(7) According to sub-section (5), the Government of Nepal, the Council of Ministers shall appoint a person who is considered suitable from among the persons submitted by the Ministry to the post of Member-Secretary.
(8) The term of office of the member-secretary appointed in accordance with sub-section (7) shall be four years and he may be re-appointed for one more time.
(9) Notwithstanding anything contained in sub-section (8), the Government of Nepal, the Council of Ministers may remove the member-secretary from office at any time in any of the following cases:-
(a) does any act prejudicial to the Council,
(b) Failure to fulfill official duties,
(c) does any act contrary to this Act, or
(d) if he does not discharge his responsibilities honestly, if his performance is not satisfactory, if he lacks efficiency or if he does not conform to the position;If the behavior is not followed or if the instructions of the Council are not followed.
(10) According to sub-section (9), before removing the member-secretary from the position, he should be given a reasonable opportunity to present his explanation.
(11) The post of Member-Secretary shall be deemed to be vacant in the following cases:-
(a) if he tenders his resignation in writing to the Chairman,
(b) If he is a non-Nepali citizen or if he obtains a permanent residence permit of a foreign country or applies for the same,
(c) if he has attained the age of sixty years,
(d) if a candidate for any office of public accountability to be appointed by election,
(e) having been convicted of corruption, extortion, human trafficking and trafficking, sale, distribution and exportation or importation of narcotic drugs, money laundering, misappropriation of passports, kidnapping offences, organized crime or criminal offense of moral turpitude or any other criminal offense for one year or If such judgment is final, punishable by more imprisonment,
(f) if removed from office under sub-section (9),
(g) If it is proved that he has escaped and later returned after going abroad on behalf of the nation,
(h) In case of his death.
(12) Notwithstanding anything contained elsewhere in this section, if the post of Member-Secretary becomes vacant for any reason or is suspended for any reason, until the appointment of another Member-Secretary or his suspension is lifted, the Ministry shall appoint a gazetted first class employee of the Federal Civil Service or the most senior employee of the Council as Member-Secretary. can be assigned to work as
(13) The remuneration, facilities and other conditions of service of the member-secretary shall be as prescribed. Thus, until the remuneration and facilities of the member-secretary are determined, he will get the remuneration and facilities as specified by the Government of Nepal.
