(1) The state requesting the extradition of a fugitive accused or criminal who is residing in Nepal or in transit within Nepal while going to a third country shall make a request to the Government of Nepal.

(2) ) When making a request in accordance with sub-section (1), the requesting state shall make the request through diplomatic channels.

(3) Regardless of what is written in sub-section (2), if the fugitive accused or fugitive criminal is not arrested and detained immediately, he will disappear. If possible, the state that demands the immediate arrest and custody of such a fugitive accused or criminal may make a request to the Ministry directly. In such case, the decision of the competent court that he is found guilty shall be provided.

(5) If a fugitive accused or a criminal is arrested on the basis of the evidence or judgment as per sub-section (4), the ministry shall provide the information to the requesting state within three days.

(6) If a fugitive accused or criminal is arrested according to sub-section (5), the requesting state shall request the extradition of such fugitive accused or criminal through diplomatic channels to the Government of Nepal within seven days from the date of receiving the information of the arrest.

p>(7) If no request is made in accordance with sub-section (6), the ministry shall immediately release the arrested fugitive accused or criminal from custody.
