Section 39
Insertion
(1) If the goods are physically integrated with other original goods in such a way that the original identity of the goods is not destroyed, such goods shall be deemed to be included in such original goods. If the mortgage right has matured at the time of attachment of the mortgaged property, then such mortgage right will be deemed to have matured in the case of the attached goods as well. (3) If the secured obligation is not fulfilled, the mortgage right over the attached goods will have priority over the claims of every person who has rights in the entire goods, and the person taking the mortgage from other goods. (4) The mortgagor who removes the included goods shall file an inquiry as follows for the material loss caused to the entire goods to a person other than the person giving the pledge who has any right in the whole or other goods, and in this way, the right of the mortgagee shall be the right of such person. shall be subject to:- (a) The mortgagee shall immediately submit to the mortgagor other than the mortgagor the cost of repairing the damage caused to the immovable property by the mortgagor, except the mortgagor. Due to the decrease in the value of such immovable property, the amount shall be deposited to the person who gave the mortgage or other person who took the mortgage. (c) The person receiving the deposit may refuse to allow the removal of such goods unless the person who takes the mortgage is able to give sufficient assurance that he will fulfill the obligation of depositing the property.
