Section 26
Non-use of government employees and public property
(1) No political party or candidate or election representative or person holding a public position or any other person shall use or cause to be used government employees and public property in connection with election campaigning. However, this sub-section will not hinder the enjoyment of the facilities provided in accordance with the prevailing law.
(2) The election officer, polling officer or monitor shall order those who act contrary to sub-section (1) to prevent the use or use of public property and the political party, candidate or person committing such act and send it to the commission for action.
(3) The political party, candidate or person who acts contrary to sub-section (1) may be fined up to fifty thousand rupees by the Commission.
(4) If the property mentioned in sub-section (1) belongs to the Nepal government, state government, local level or an organization owned by the Nepal government, state government or local level, departmental action will be taken against the official who allows such property to be used.
