(1) The establishment may transfer workers from one office, branch or unit to another office, branch or unit of the establishment without adversely affecting their service conditions and facilities and without affecting the nature and level of their work. But in the following cases, the nature and level of work can be transferred in a different way:-
(a) With the consent of the worker concerned,
(b) In case of promotion and posting of workers,
(c) as specified in the collective agreement, or
(d) To transfer any worker to other work related to training or skill or educational qualification received.
(2) Workers working in one establishment can be transferred to another establishment with their consent.
(3) When transferring in accordance with sub-section (2), the service period of the worker to be transferred shall be added and all facilities and other conditions of service received on the basis of the service period shall be borne by the transferee establishment and the transferee and the transferee establishment shall enter into an agreement as specified.< br> (4) The employer shall provide the prescribed facilities when the worker is transferred out of the place of permanent residence or former workplace.
