Rule 36
Consent required

(1) According to the sub-rule (2) of rule 34, the committee will make a recommendation to the District Development Committee if it deems it necessary to grant a permit for the mining of general construction mineral materials according to the demand of the petition.
(2) After receiving the recommendation from the committee in accordance with sub-rule (1), the District Development Committee shall, before granting the permit to the petitioner for mineral operations, specify the details of the mining area, mining method, area and the name of the mineral material in relation to the petitioner's demand. It should be sent in writing for the consent of the department.
(3) According to sub-rule (1), within six months of writing to the committee, the department shall make a decision regarding the matter for which such consent is requested, in which manner, how, and under which conditions the permit is to be granted under the restrictions. But if the department decides not to issue a license to operate the mine, the license will not be granted.
(4) Notwithstanding anything written in sub-rule (2), if the area recommended for mining is within the forest area, the district development committee shall also obtain the consent of the Ministry of Forestry and Land Conservation before obtaining the consent of the department.
