(1) A bidder or a proposer may apply to the head of the concerned public body for review of such error or decision if the public body makes any mistake or fails to comply with the duty to perform the procurement process or decision, and the reason is that he will be harmed or may be harmed.
(2) The petition for revision given in accordance with sub-section (1) shall be limited to the proceedings before the purchase agreement.
(3) When making an application in accordance with sub-section (1), if a period is specified in this Act for submitting such an application, within such period and if such period is not specified, the application shall be submitted within seven days from the date on which the bidder or proposer learns that the public body has made an error related to the procurement process or has not complied with its duties. .
(4) In the petition as per sub-section (1), it must be clearly disclosed that the public body did or did not perform such an error or did not comply with the duty and that such decision is contrary to this Act or the provisions of the rules or guidelines made under this Act.
(5) No action shall be taken on the application for review received after the period specified in sub-section (3).
(6) If any error is found in the procurement process during the investigation regarding the application received under sub-section (1), if the public body does not comply with the duty to be followed or if such decision is found to be contrary to the law, the head of the public body shall suspend the procurement process and disclose the reason within five days of receiving the application. A written decision should be made.
(7) In the decision according to sub-section (6), it should also be mentioned how to proceed with the procurement process.
(8) If the application under sub-section (1) is related to the purchase action of an amount less than the specified amount, the head of the public body shall not submit an application to the review committee for review of the decision made under sub-section (6).
