Section 41
Purchase of Secured Sale Agreements and Warrants
In the following cases, the purchaser of the secured sale agreement or warrant shall have priority over the rights of the disputed security over the secured sale agreement or warrant and also over the profit derived therefrom:- (a) In the course of regular commercial transactions of the receiver, the receiver gives a new price for the secured sale agreement or warrant. If the title deed has been taken into possession, and (b) if it is not mentioned in the secured sale agreement or title deed that it has been transferred to the person who has the disputed mortgage right.
