Rule 4
Posts in the Military Miscellaneous Service Group
The following posts in the Military Miscellaneous Service Group will be held: (2) The position as per clause (a), the official as per clause (b) and clause (c) of sub-rule (1) For the post to be filled through the internal competition for the post of Jamdar, those who have attained the educational qualification required for the post and who are working in any post of the Nepali Army lower than the post to be filled can be candidates.
(3) For the post to be filled by internal competition for the post of sub-senior as per clauses (a), (b) and (c) of sub-rule (1),Candidates who have completed at least ten years of service in the post of the relevant group who have attained the required educational qualification can be eligible candidates.
(4) Notwithstanding anything written in sub-rule (1), forty-five percent of the posts to be filled by open competition shall be reserved and the said percentage shall be considered as 100%, and the posts shall be filled by separate competition only among the following candidates:-
(a) Women – twenty percent
(b) Adivasi/Tribal – Thirty two percent
(c) Madheshi – twenty eight percent
(d) Dalits – fifteen percent
(e) Backward Areas – Five percent Explanation:
(1) For the purposes of this sub-rule, "women, tribals/tribes, Madhesi, Dalits" means economically and socially backward women, tribals/tribals, Madhesi and Dalits.
(2) For the purposes of clause (e), "backward area" means the districts of Manang, Mustang, Acham, Kalikot, Jajarkot, Jumla, Dolpa, Bajhang, Bajura, Mugu and Humla.
(3) A person who is a candidate according to clause (b), (c) or (d) can compete only as a candidate of a group of one of the clauses.
(4) For the purpose of filling posts according to this sub-rule, the details of economically and socially backward women, tribals/tribes, Madhesi and Dalit groups shall be as prescribed by the Government of Nepal by publishing a notice in the Nepal Gazette. However, all women, tribals/tribals, Madheshis and Dalits will be considered economically and socially backward until such notice is published in the Nepal Gazette.
(5) The following documents should be attached while applying for the posts allotted in accordance with this sub-rule:-
(a) For tribals/tribes who have been certified as tribals/tribes by the Nepal Tribal/Tribal Upliftment National Institute, but if there is more than one surname within the caste listed in the Nepal Tribal/Tribal Upliftment National Foundation Act, the surname within the tribe listed by the chief district officer on the recommendation of the head of the local level concerned It should be certified and submitted along with the application.
(b) as a Dalit by the National Dalit Commission for DalitsIf there is more than one surname within the caste that has been verified, but is listed by the National Dalit Commission, it should be certified as a surname within the caste listed by the Chief District Officer on the recommendation of the head of the local level and submitted with the application.
(c) For Madhesi, the government of Nepal shall publish a notice in the Nepal Gazette and certify that they are Madhesi from a designated institution, but until the institution is designated by publishing a notice in the Nepal Gazette, the concerned local level head shall submit the application along with a certificate of Madhesi from the chief district officer.
(d) On the basis of a certificate of citizenship obtained from the relevant district mentioning permanent residence in the district mentioned in clause (2) of the explanation for backward areas and on the basis of proof of the current permanent residence in the same place from the relevant village municipality or municipality.
(5) When determining the percentage according to sub-rule (4), if a coefficient (fraction) of less than one percent is obtained, such coefficient will be shifted to the next group immediately after that.
(6) According to sub-rule (4), if suitable candidates are not available in the advertisement for the year for which the advertisement is made, or if the required number of candidates do not pass, the position cannot be filled, then such position shall be included in the advertisement for that year to be filled by open competition.
