Section 14
The employment relationship will continue even if the ownership changes
: (1) If the ownership of an employer's work or business or any part of it is changed or transferred according to law, or if it is given to someone else to operate such work or business, or if two or more establishments or businesses merge. If a new establishment or business is created by merging, the employment relationship of the workers employed in the merged establishment or business, whose ownership has been changed or transferred or given to someone to operate, will continue.
(2) For the purpose of sub-section (1) in accordance with this Act or the rules made under this Act, or if there is a collective agreement, the employer or establishment or business who assumes ownership or transfers and receives or undertakes to operate the work or business. In the case of merger, if ownership and responsibility of the project is transferred in accordance with the existing law regarding private investment in the construction and operation of a new establishment or business or infrastructure structure created by such merger, the establishment that takes responsibility for such ownership and responsibility shall transfer it. However, if there is an agreement between the former employer, the new employer and the union of the related establishment regarding the interim management, the provisions of the agreement will be applied.
