Conflict of interest issues should not be considered

(1) A judge shall not try, hear or dispose of the following cases:-
(a) Matters concerning the rights, interests or concerns of oneself or one's close relative. (e) For any other reason, the interests of him and his immediate family members are fundamentally conflicting or the interests of the persons referred to in Clause (a) are conflicting.
(2) If there is any situation as per sub-section (1), the judge hearing the case shall issue an order for the case not to be heard.
(3) If a judge decides to proceed, hear or set aside a case contrary to sub-section (1), any party to the case may file an application not to proceed, hear or set aside the case with necessary evidence.
(4) If an application under sub-section (3) is received, the judge hearing the case shall, before proceeding, hearing or disposing of the case, determine whether or not the demands and claims as per such application are reasonable or not, and if the case should not be heard, he shall make an order accordingly.
(5) If there is an order under sub-section (2) or (4), if such a case is another judge of the same court, he and if there is no such judge, the case should be sent to the nearest court of the same level for the proceedings, hearing and settlement of the open case, and the parties should also send a date to the same court. .
(6) If a mistrial is received in accordance with sub-section (5), even if the case is not within its jurisdiction, such court shall also take action, hear and dispose of such case.
