Section 18
Decisions should not be made if interests conflict

(1) If the officer entitled to make a decision in accordance with this Act or other prevailing laws has any interest, concern or self-interest directly in the matter to be decided, or if the decision made by him is directly affected by a person or other close relative, or if the business conducted by a person of one of his close relatives, If there is a conflict of interest in the business, such an officer cannot make a decision on such a matter. Explanation: For the purpose of this sub-section, the decision made by the official who has the right to make a decision for the greater public interest is not considered to be a conflict of interest.
(2) If the decision-making officer fails to make a decision under subsection (1), the reason should be disclosed to him, if he is in the same office, and if not, he should be allowed to make a decision on the matter.
(3) If the official under sub-section (2) is not in the relevant office, or if the decision cannot be made under the conditions under sub-section (1), if the decision-making authority is a secretary, then the decision must be submitted to the chief secretary, and if there is another official, the decision must be made according to the decision. Since the Chief Secretary is the decision-making authority, the matter should be submitted to the Government of Nepal (Council of Ministers).
(4) Production of any goods or services under the same sector or sub-sector at any non-governmental or private level related to the decision made by an officer working in a policy-making or law-enforcing body of a sector or sub-sector or in a regulatory body regulating a sector or sub-sector while in office. doing, doing any business or in the management of a firm, company or any other establishment that produces such goods or services, as long as he remains in his position, Rajun cannot be directly or indirectly involved for at least one year after retiring from such position for any reason. (6) A person who is not satisfied with the order given in accordance with sub-section (5) may appeal to the relevant appellate court within thirty-five days.
