Rule 46
Transferable or transferable right –

(1) Notwithstanding anything written elsewhere in this regulation, the lessee who works satisfactorily for one-third of the period of acceptance may transfer or sell his rights to any other organized organization, industry or community. In this way, in order to transfer or sell their rights, the concerned lessees will have to take the prior approval of the Ministry.
(2) Upon submission of an application for approval of transfer of rights or sale in accordance with sub-rule (1), if the Ministry wishes to purchase the forest produce planted or grown by the lessee in the said forest on behalf of the Government of Nepal, it may pay the lessee an amount equal to the value of the said forest produce as per Schedule-2.
(3) If the confessional forest transferred or sold as per sub-rule (1) is purchased by any organized organization, industry or community, it shall be deemed to have been transferred to the buyer in the confession made by the former Pattawala with the Government of Nepal.
(4) In the case of the transfer or sale of the concession forest according to sub-rule (1), the director shall keep his records up-to-date stating the transfer or sale of the concession forest.
