Section 58
Expiration of time limit
If the following circumstances beyond the control of a person arise and he is unable to register a complaint within the time limit, if he brings the complaint to be registered within the following period after mentioning the fact that the limitation period has passed, the court shall register such complaint under section 59, regardless of what is written elsewhere in this paragraph:-
(a) If a person who has to register a complaint has died and he has to live as a kiriya or a kiriya-like person according to tradition, seven days from the date of fifteen days of the death of such a person excluding the period of travel,
(b) If the person who has to register a complaint is a woman and has given birth, sixty days from the date of delivery excluding the period of leave,
(c) If the road is closed due to landslides or snow or curfew is announced or public transport is not running due to any other reason, fifteen days from the date of opening of the road or public transport is running, (d) If the person to whom the complaint is to be filed has been abducted or taken hostage by someone, fifteen days from the date of release from such abduction or hostage, (e) In case of calamity like earthquake or volcano etc., ten days from the date of such calamity excluding the period of travel,
(f) In the case of being unconscious or unable to walk due to an accident or unable to walk due to a sudden serious illness and having to be admitted to a hospital for treatment, fifteen days from the date of such admission excluding the period of travel.
(g) If a person is unable to file a complaint within the time limit when filing a complaint under the conditions under section 50 or 58, he must submit an application to the court along with the necessary evidence to confirm it.
(h) According to sub-section (1), if the court shows the reason for not being able to submit the evidence along with the application and requests a deadline for the same, the court may grant the person who wants to file a complaint to submit such evidence within fifteen days without further extension.
