Section 3
Election of members
: (1) For the election of members to be elected in accordance with Clause (a) of clause (2) of Article 86 of the Constitution, the Electoral Board formed in each province shall elect eight members from each province by secret ballot as follows:-
(a) the three persons obtaining the highest number of votes on the basis of one vote each for the member representing the women's group,
(b) one person who obtains the highest number of votes on the basis of one vote for a member representing a Dalit group,
(c) one person who obtains the highest number of votes on the basis of one vote cast for a person with disabilities or a member representing a minority community,
(d) The three persons who get the highest number of votes on the basis of one vote for members other than clauses (a), (b) and (c).
(2) Notwithstanding anything written in sub-sections (a) and (d) of sub-section (1), the position of any member elected in accordance with that section becomes vacant for any reason and at the time of by-election or the term of office established in accordance with sub-section (3) of Article 86 of the Constitution expires. In the event that only one member of a group has to be elected, the person who gets the most votes based on one vote given by the voters from the same group and method will be elected.
