Section 29

In accordance with sub-section (3) of section 27, if an order is received from the central authority to provide mutual legal assistance, the relevant district public prosecutor shall submit an application to the relevant district court along with the details, documents and evidence received from the foreign state.
(2) The court may refuse to provide mutual legal assistance if the following conditions are observed while examining the application received under sub-section (1) and the attached details, documents and evidence:
(a) If an application is made for mutual legal assistance in a matter related to an offence, if it appears prima facie that such an offense cannot be established,
(b) Mutual legal assistance if contrary to general principles of justice.
(3) Notwithstanding anything written in sub-section (2), the court may refuse to provide such mutual legal assistance even if the situation as per that sub-section is observed at any time.
