Limitation of Complaint Filed in a Court Without Jurisdiction
If someone has filed a complaint in a court and for some reason it appears that such court does not have the jurisdiction to process, hear and dispose of such complaint, it shall be considered that the limitation of the complaint of the person concerned shall remain in force for the period from the date the court has concluded the proceedings in that regard. .But,
(1) If the period of limitation is less than seven days, the limitation period for filing a complaint will continue for seven days.
(2) The time limit for filing a petition in accordance with this section cannot be extended just because the court held that it did not have jurisdiction at the time of the filing of the complaint.
(3) After knowing that the court in which the complaint is registered does not have the jurisdiction to process, hear and dispose of it, it shall not be considered that the concerned person has been hindered from filing the complaint in the competent court within the limits of the law.
(4) Even after the statute of limitations has passed, jurisdiction cannot be maintained for filing a statute of limitations petition just because the petition has been filed.
