Rule 77
Compulsory leave
(1) Military personnel other than officers employed in the military general service of the Nepalese Army shall be retired from service after attaining the following age:-
(a) Chief Subedar Fifty years (b) Subedar Fifty-nine years
(c) Jamdar Forty-eight years
(d) Tenure of forty-seven years (e) Amaldar forty-seven years
(f) Back forty-six years
(g) Soldier Forty-six years
(h) Followers fifty-five years
(2) Notwithstanding anything contained in clause (a) of sub-rule (1), the Chief Subedar shall hold office for a period of three years from the date of his promotion and the authority of the Senior Subedar of Gulm shall remain in office for three years from the date of taking over the appointment of the Senior Subedar. In the case of Chief Subedar and Senior Subedar of Gulm, who are working at the time of commencement of this Bye-law, this arrangement shall be applicable only after two years from the date of commencement of this Bye-law. But if the period of retirement is not reached, the spouse may continue in the appointment until the retirement period is reached.
(3) When calculating the age of a military person for the purpose of this rule, if the date of birth, year, month and day of birth, year, month and date are disclosed in the personal details, citizenship certificate and educational qualification certificate and if they do not have the same date in all of them, the retirement will be given from the date from which the retirement occurs first.
(4) When the date of birth is established on the basis of a certificate that only mentions the year or year, it shall be established as follows:-
(a) In case of certificate of Nepalese citizenship, based on the date of receipt of such certificate,
(b) In the case of a certificate of educational qualification, on the basis of the date of issue of the certificate,
(c) In case of personal details, based on the date of initial admission.
(5) If only the year is mentioned in a certificate and the full date of birth is disclosed in another certificate, and if there is a gap of up to one year between the dates of birth mentioned in such certificate, then the fully disclosed date of birth shall be considered as the basis. However, if the difference between the dates of birth mentioned in separate certificates is more than one year, the date of birth will be established according to sub-rule (4) on the basis of the certificate in which only the year is mentioned.
