(1) If a person receives any benefit or facility from anyone without the reason that a person has to act in accordance with the law or fulfill an obligation, the person receiving such benefit or facility shall be considered to have received unfair enrichment.
(2) The unjust enrichment as per sub-section (1) shall be deemed to have been received in the following cases:-
(a) If there is an increase in his assets or a decrease in his liabilities,
(b) If he obtains the services of another or causes someone to work,
(c) If someone else's property is used for him.
(3) Notwithstanding anything contained in sub-section (1) or (2), any person receiving any goods, services, benefits or facilities in any way shall be deemed to have received unjust enrichment except in the following cases:-
(a) If any goods, services, benefits or facilities can be obtained from any person according to law or contract,
(b) If any item, service, benefit or facility has been received from the person from whom such person has received it with free consent without asking for return or reimbursement.
(4) According to this paragraph, when determining whether or not a person has received unjust enrichment or to what extent, after receiving unjust enrichment, such person shall not be considered to have suffered a disadvantage or loss due to it.
(5) According to this section, if someone receives unjust enrichment, he shall bear the liability according to this paragraph.
