Rule 19
Issuance of permit
(1) Sub-rule (1) of rule 16 or sub-rule 18
According to (3), if there is a project investment agreement, within ten days of such agreement, the relevant investor shall submit an application to the office to obtain a permit along with a copy of the agreement.
(2) If an investor is unable to submit an application to the office to obtain a permit within the period specified in sub-rule (1), he/she shall file a request for an extension of the deadline for obtaining a permit before the Disclosure Board.
(3) The board may extend the deadline by not more than one month if the reason for the application is found to be reasonable according to sub-rule (2).
(4) The office will issue a project investment permit in the form of schedule-3 on behalf of the board to the investors who contact within the extended period according to sub-rule (1) or (3).
(5) If the board approves the project investment with conditions according to sub-section (8) of section 10 of the Act, when the relevant investor applies to the office to obtain a permit according to sub-rule (1), the information must have been given to the office including the fulfillment of such condition or the commitment to fulfill such condition.
(6) In addition to the license fee to be paid by the office according to the nature of the project in accordance with the prevailing law, when granting the permit according to sub-rule (4), one lakh rupees or 0.20% (zero decimal two zero percent) of the project cost from the concerned investor, whichever is higher. That amount will have to be filed with the Nepal government for the permit. But according to the prevailing law, if such a bill has to be filed with any body other than the Government of Nepal, then the amount to that extent should be paid to that body.
