Rule 53A
List of Permits
(1) A person who has received a license cannot transfer the license to someone else's name without taking the prior approval of the department.
(2) If the person who has received the permit wishes to transfer the name of the permit to someone else, the person who wants to transfer the name should submit an application for the transfer to the department along with proof of eligibility as per Rule 5.
(3) If an application is received in accordance with sub-rule (2), the department shall make a necessary inquiry as to whether the person who wants to be transferred is qualified as per rule 5 and decide whether or not to transfer the name within thirty days from the date of receipt of the application.
(4) If the person who wants to get a license under sub-rule (3) is qualified according to rule 5, and if the department deems it appropriate to issue a permit to do mineral work, he can take the form as per Schedule-4 and issue a license in his name.
(5) If the person who received the permit dies or is unable to comply with the conditions specified in the permit or the Act or these regulations at the time of issuance of the permit due to any other reason, the owner of the permit shall attach proof that he is the closest owner to exercise his right, if the department submits an application to the department. If the right holder is found to be eligible according to Rule 5 after necessary investigation, he can take the name change procedure as per schedule-4 and give the permit in his name.
(6) When the department inquires about the transfer of the name of the license according to sub-rule (5), if it is found that there is any issue regarding the right of the person who received the license, such license cannot be transferred to anyone's name until such issue is resolved.
