Section 8
Provision of Permit

(1) A person or an organization wishing to survey or use water resources shall submit an application for a permit to the designated authority or body with the relevant economic, technical and environmental study report and the specified details. However, it is not necessary to attach such a study report when applying for a water resource survey permit.
(2) The authority or agency specified in the application submitted under sub-section (1) shall carry out the necessary examination and shall specify the necessary conditions in the prescribed format within thirty days in the case of water resource survey permit and within one hundred and twenty days in the case of water resource use permit from the date of application, as mentioned in subsection (1) of section 7. According to the order of priority, the permit should be given to the applicant.
(3) Except as per sub-section (2) of Section 4, the person or organization that has been using water resources before the commencement of this Act shall also submit an application for a permit to the designated authority or body within one year from the date of commencement of this Act with the prescribed details.
(4) The authority or agency specified in the application submitted under sub-section (3) shall issue a permit in the prescribed format within sixty days from the date of submission of the application.
(5) The person who has received the permit must pay the prescribed fee or annual fee to the Government of Nepal for the use of water resources.
(6) If the license holder has to sell his license or transfer it to someone in any other way, he must obtain approval from the designated authority or agency as specified.
