: Notwithstanding anything contained in section 5, the following persons shall not be eligible to be appointed or to hold office as Chairman or Member:-
(a) Non-Nepalese citizens,
(b) Having obtained a permanent residence permit of a foreign country,
(c) having been convicted of corruption, extortion, human trafficking and trafficking, drug trafficking, money laundering, passport misuse, kidnapping related offenses or other criminal offenses of moral turpitude,
(d) Not less than three years from the date of blacklisting or release from such list as per prevailing law,
(e) He or a member of his immediate family is involved in the capacity of founder, managerial level, shareholder or manager, auditor or consultant of any company or subsidiary company, firm or organization involved in electricity generation, transmission, distribution or trade, or having separated from such a position. A period of at least three years has not elapsed. Explanation: For the purpose of this clause, "shareholder" means a person who owns at least one percent of the shares of the concerned company.
(f) Not having completed the period of three years from the date of conviction for an offense related to electricity production, transmission, distribution or business.
(g) incumbent employees of the Government of Nepal, the State Government or the local level or an organized organization owned by the Government of Nepal, the State Government or the local level or a person who has received a permit.
(h) If the creditor is unable to pay his debt, he falls into debt.
(j) Being a member or official of any political party.
